 2015 CASE RESULTS

The results listed below are real case results on criminal and traffic cases litigated throughout Allegheny County and Western Pennsylvania in 2015. For client confidentiality purposes, the names and case details are not listed below.

DECEMBER 2015

  • DRIVING ON A SUSPENDED LICENSE DUI RELATED (Allegheny): Client facing mandatory 60-day jail sentence and 12-month license suspension. Result: Charge reduced to a Failure to Exhibit License Upon Demand violation for no points, jail time or license suspension. Client now has valid driver's license. 
  • DISORDERLY CONDUCT (Allegheny): Client with warrant for failure to respond to the non-traffic citation. Result: Warrant cleared and agreement negotiated for client to remain free from criminal conduct for 90 days in return for full withdrawal of charge. 
  • UNDERAGE DRINKING, FAKE ID, AND PUBLIC DRUNKENNESS (Allegheny): Client with clean record facing criminal record for minimum period of 5 years, along with a 6-month license suspension upon conviction. Result: Negotiated agreement for client to complete community service for full withdrawal of charges.
  • DUI - 1st OFFENSE (Allegheny): Client with prior felony record received first DUI offense, carrying 72-hour jail sentence and 12 month driver's license suspension. Originally rejected from ARD consideration. Result: After drafting letter to head of ARD Program, the client was offered admission into the ARD program. No jail time, license suspension reduced to 30 days, and charge to be dismissed in future. 
  • POSSESSION OF A CONTROLLED SUBSTANCE (Allegheny): Client facing permanent criminal record, 6 month driver's license suspension, and max sentence of up to 1 year in jail. Result: Negotiated Probation Without Verdict plea, where record will be expunged in future. No jail time or license suspension. 
  • DRIVING ON A SUSPENDED LICENSE - DUI RELATED (Washington): Client facing 60-day jail sentence. Result: Negotiated plea to Driving on Suspended License, Non-DUI related, eliminating jail time. 
  • DISORDERLY CONDUCT AND CARELESS DRIVING (Allegheny): Client facing criminal record for the disorderly conduct offense and 3 points on driver's license. Result: Negotiated agreement for withdrawal of disorderly conduct offense. 
  • SPEEDING - 30 MPH OVER and CARELESS DRIVING: Client facing a 15-day driver's license suspension, an written exam with PennDOT and a total of 8 points . Result: Negotiated plea to 10 mph over and a traffic control devices offense, eliminating suspension and exam, and a reduction from 8 points down to 2. 
  • CARRYING FIREARM WITHOUT A LICENSE (F3), RECEIVING STOLEN PROPERTY (F2), POSSESSION OF MARIJUANA (M): Client facing maximum sentence of up to 17 years in jail and a 6-month driver's license suspension. Result: Negotiated plea agreement for 18 months of probation and no license suspension. 
  • SIMPLE ASSAULT (M2): Client facing maximum sentence of up to 2 years in jail. Result: Charges withdrawn at Magisterial District Court.
  • DUI (M), CRIMINAL MISCHIEF (M3), PUBLIC DRUNKENNESS (S) - WASHINGTON: Client facing a 12-month suspension of CDL, 72-hour jail sentence and permanent criminal record. Result: Proceeded to a preliminary hearing where the DUI charge was dismissed, the criminal mischief was reduced in grading, and the client was found guilty of two summary offenses for fines, costs and restitution. All misdemeanor charges dismissed.
  • SPEEDING - 30MPH OVER - ALLEGHENY: Client facing 5 points on driving record. Result: Negotiated plea to 10mph over, reducing points from 5 to 2. 
  • MULTIPLE CASES - SIMPLE ASSAULT (M2), ENDANDERING THE WELFARE OF A CHILD (M1), HARASSMENT (S) - ALLEGHENY: Client facing multiple counts on three separate criminal cases. Result: Motion to dismiss granted, all three cases dismissed after witnesses failed to appear in court. 
  • DRIVING ON A SUSPENDED LICENSE - DUI RELATED - ALLEGHENY: Client facing 12-month license suspension and 60-day jail sentence for offense that occurred days prior to reinstatement of driving privileges. Result: Successfully argued during hearing for a reduction of offense to a Failure to Exhibit License Upon Demand, carrying no points, suspensions or jail time. Client's driving privileges remain intact.

NOVEMBER 2015

  • CARELESS DRIVING, DRIVING AT SAFE SPEED, AND FAILURE TO KEEP RIGHT - ALLEGHENY: Client facing 5 points on driving record. Result: Proceeded to summary trial where client convicted of careless driving and acquitted of driving at a safe speed, reducing points from 5 to 3. 
  • BURGLARY (F1) AND CRIMINAL MISCHIEF (S) - ALLEGHENY: Student with clean record facing maximum sentence of up to 10 years in prison, and a permanent felony record. Result: Negotiated agreement to a summary disorderly conduct for court costs and restitution only. Client eligible to expunge felony charge from record. 
  • FORGERY (F2) AND THEFT (M2) - ALLEGHENY: Student with clean record facing maximum sentence of up to 9 years in jail and permanent criminal history. Result: Negotiated agreement for client to pay restitution in return for a reduction to a summary offense, for fines and court costs only. Felony and misdemeanor charges can be expunged in future. 
  • SPEEDING 25+MPH OVER - ALLEGHENY: Client facing 5 points on driving record, placing him/her 1 point away from PennDOT sanctions. Result: Negotiated plea to 5mph over for 0 points. 
  • UNDERAGE DRINKING - ALLEGHENY: College aged client facing mandatory 90-day driver's license suspension and criminal record. Result: Negotiated agreement for client to complete underage drinking course at an out-of-state university for a full withdrawal. No community service required. 
  • SPEEDING 20+MPH OVER, CARELESS DRIVING, DRIVING AT SAFE SPEED - SUMMARY APPEAL - ALLEGHENY: Client unrepresented at Magisterial District Court convicted of offenses carrying 9 points on driving history. Filed summary appeal to challenge conviction. Result: Careless Driving and Speeding offenses reduced to offenses carrying no points. Driving at Safe Speed conviction upheld. Total points reduced from 9 to 2 points. 
  • UNDERAGE DRINKING (S) - ALLEGHENY: Two college aged clients facing mandatory 90-day driver's license suspension and criminal record. Result: Negotiated agreement with officer and magisterial district judge to perform community service and take underage drinking course in return for a full withdrawal of charges. 
  • DUI (M) - JEFFERSON: Client facing mandatory 72-hour jail sentence and 12-month license suspension. Result: Negotiated entry into ARD program, which will lead to charges being dismissed in the future, no jail time, and reduced license suspension to 60 days. 
  • DRIVING ON A SUSPENDED LICENSE - DUI RELATED (WASHINGTON): Client who was close to having license reinstated was facing an additional 12-month suspension and mandatory 60-day jail sentence. Result: Worked with the client to take steps towards the restoration of driving privileges. Presented documentation to police officer, who agreed to reduce charge to a Failure to Exhibit License Upon Demand, carrying no points, suspensions or jail time. 
  • DRIVING ON A SUSPENDED LICENSE - DUI RELATED (BUTLER): Client who was close to having license reinstated was facing an additional 12-month suspension and mandatory 60-day jail sentence. Result: Worked with the client to take steps towards the restoration of driving privileges. Presented documentation to judge during summary trial. Charge was reduced to a Failure to Exhibit License Upon Demand, carrying no points, suspensions or jail time. 
  • UNDERAGE DRINKING - ALLEGHENY: Client facing criminal record and mandatory 90-day driver's license suspension. Result: Negotiated agreement for community service for a full withdrawal of charge, eliminating license suspension.
  • DUI - 1st OFFENSE - ALLEGHENY (M): Client facing mandatory 72-hour jail sentence and 12-month license suspension. Result: Negotiated entry into the ARD program, eliminating jail time, reducing suspension to 60-days, and leading to an expungement of criminal record upon program completion. 
  • DUI - 3RD OFFENSE IN 10 YEARS - ALLEGHENY (M1): Client facing mandatory minimum jail sentence of 1-2 years upon conviction. Result: Motion to dismiss charges at magisterial district court granted when Commonwealth witnesses failed to appear. 
  • UNDERAGE DRINKING - ALLEGHENY: Client facing criminal record and mandatory 90-day driver's license suspension. Result: Negotiated agreement for community service for a full withdrawal of charge, eliminating license suspension. 
  • FURNISHING ALCOHOL TO MINORS (M3) - ALLEGHENY: Client facing criminal record, mandatory 90-day driver's license suspension, and max sentence of up to 1 year in jail. Result: Negotiated agreement at magistrate's office for client to complete parenting classes for a reduction to a summary disorderly conduct offense. No license suspension. 
  • DRIVING ON A SUSPENDED LICENSE DUI RELATED - ALLEGHENY: Client facing 60-day jail sentence and $500 fine. Result: Negotiated plea to a Driving on a Suspended License, Non-DUI Related offense, eliminating jail time and reducing fine to $200.
  • SPEEDING 30+ OVER - BUTLER: Client convicted at magistrate's office when unrepresented with 15-day driver's license suspension and 5 points imposed. Our firm filed a summary appeal and appeal of her driver's license suspension. Result: Charge reduced to 15mph over at summary appeal hearing, eliminating suspension and reducing points from 5 to 3. 
  • ACCIDENT WITH ATTENDED VEHICLE (M3) - ALLEGHENY: Client facing criminal record and max sentence of up to 1 year in jail. Result: Plea to summary disorderly conduct at magistrate's office for fines and court costs only.

OCTOBER 2015

  • PROSTITUTION (M3) - 2 Cases - Allegheny: Two separate clients with clean records facing permanent criminal record and max sentence of up to 1 year in jail. Result: Negotiated agreement to complete classes for a plea to a summary disorderly conduct, allowing client to file expungement petition in future. 
  • RETAIL THEFT (S) - Allegheny: Client with clean record facing potential criminal record and maximum jail sentence of up to 90 days in jail. Result: Negotiated agreement for completion of ASI classes for withdrawal. 
  • POSSESSION OF DRUG PARAPHERNALIA - 2 COUNTS - Allegheny: Client facing potential probation violation and max sentence of up to 2 years in jail. Result: Negotiated plea to single count of disorderly conduct for a fine and court costs only. Misdemeanor charges withdrawn. 
  • OVERTAKING SCHOOL BUS - Allegheny: Client facing mandatory 60-day license suspension and 5 points on license. Result: Negotiated plea to an alternative offense carrying no points or suspension.
  • DRIVING ON A SUSPENDED LICENSE DUI RELATED - Washington: Client facing 60 day jail sentence, filed summary appeal. Result: Case dismissed. 
  • ACCESS DEVICE FRAUD (M1) - 3 COUNTS - Allegheny: Client facing maximum sentence of up to 15 years in jail. Result: Negotiated plea to three counts of disorderly conduct for time served. Misdemeanors dismissed. 
  • RETAIL THEFT (M1) and DRIVING ON A SUSPENDED LICENSE DUI RELATED (2 CASES) - Allegheny: Client facing mandatory minimum jail sentence of 60 days on each suspended license violation and a max sentence of up to 5 years in jail on the retail theft count. Result: Negotiated disorderly conduct plea, and plea to suspended license offenses for house arrest. 
  • CRIMINAL MISCHIEF (M3) - Allegheny: Client with clean record facing permanent criminal record and maximum sentence of up to 3 years in prison. Result: Negotiated restitution and community service agreement for a full withdrawal of charge. 
  • PUBLIC DRUNKENNESS, PUBLIC URINATION AND DISORDERLY CONDUCT - Allegheny: Client with clean record facing permanent criminal record for minimum period of 5 years. Result: Negotiated community service agreement for a full withdrawal of all three citations. 
  • UNDERAGE DRINKING - Allegheny (2 Cases): Two clients facing criminal record and mandatory 90-day driver's license suspension. Result: Negotiated community service agreement for a full withdrawal of charge.
  • DRIVING ON SUSPENDED LICENSE - DUI RELATED - Allegheny: Client facing 60-day jail sentence and mandatory $500 fine. Result: After receiving no plea offer, proceeded to summary trial. Successfully argued for a guilty verdict on a non-DUI related offense, a lesser offense carrying no jail sentence.
  • CRIMINAL MISCHIEF (S) - Butler: Client with clean record facing criminal record for minimum period of 5 years. Result: Charge withdrawn.
  • DRIVING ON SUSPENDED LICENSE - Butler: Client facing mandatory 12-month driver's license suspension. Result: Charge withdrawn based upon agreement where client took material steps to regain driving privileges. Client set to regain driver's license in 90 days.
  • SPEEDING 20+MPH OVER AND REQUIRED FINANCIAL RESPONSIBILITY - Westmoreland: Client facing 4 points on driver's license for speeding and mandatory 90-day driver's license suspension for RFR violation. Result: Negotiated agreement for withdrawal of RFR citation, and reduced speed to 10mph over, points reduced from 4 to 2 points, and no license suspension.
  • DUI - Allegheny: Client with prior criminal charges facing 1st offense DUI. Result: Entry into ARD program.
  • POSSESSION OF SMALL AMOUNT OF MARIJUANA (M) - Allegheny: Client with clean record facing permanent criminal record, maximum jail sentence of up to 30 days in jail, and a mandatory 6-month driver's license suspension. Result: Negotiated agreement for drug and alcohol evaluation for a full withdrawal of charges.
  • PUBLIC DRUNKENNESS - Allegheny: Client with clean record facing 5-year minimum criminal record. Result: Negotiated agreement to complete community service for full withdrawal. 
  • SIMPLE ASSAULT (M2) AND THEFT BY UNLAWFUL TAKING (M1) - Allegheny: Client facing permanent criminal record and maximum sentence of up to 7 years of incarceration. Result: Negotiated agreement for completion of anger management program for a withdrawal of all misdemeanors and plea to summary offense. 
  • DRIVING ON SUSPENDED LICENSE - DUI RELATED - Allegheny: Client facing mandatory 60-day jail sentence and 12 month license suspension. Result: Case dismissed.
  • MOTION TO RECONSIDER SENTENCE - Washington: Client sentenced to 60-day jail sentence without permission for work release based upon failure to appear on hearing date. Filed motion to request client be given permission for work release from jail. Result: Motion granted, work release permitted.

SEPTEMBER 2015

  • SPEEDING - 20+MPH OVER - Allegheny: Client with clean driving record facing 4 points on driving record. Result: Charge reduced to 5mph over for no points or suspension.
  • POSSESSION WITH INTENT TO DELIVER (F) AND CONSPIRACY (F) - Allegheny: Client facing permanent felony record, and max sentence of up to 7 years in jail for alleged involvement in drug deal to an undercover police officer. Result: Negotiated agreement to a misdemeanor simple possession offense for 12 months of probation, felony charges withdrawn. 
  • SIMPLE ASSAULT (M2) - Allegheny: Domestic case where client facing criminal record and max sentence of up to 2 years in jail. Result: Charges withdrawn after completion of a drug and alcohol evaluation
  • FALSE IDENTIFICATION TO LAW ENFORCEMENT (M3), DISORDERLY CONDUCT (M3) AND UNDERAGE DRINKING (Allegheny): Student facing criminal record, 90-day driver's license suspension and max sentence of up to 27 months in jail. Result: Negotiated agreement for completion of community service for full withdrawal of charges.
  • SAFE SPEED VIOLATION - CONSTRUCTION ZONE - Beaver: Client facing 2 points on license for speeding through a work zone. Result: Negotiated agreement to an alternative traffic offense without points or a suspension.

AUGUST 2015

  • POSSESSION OF A CONTROLLED SUBSTANCE (M) AND POSSESSION OF DRUG PARAPHERNALIA (M) - Allegheny: Client facing criminal record and maximum sentence of up to 18 months in jail. Result: NOT GUILTY AFTER NON-JURY TRIAL

  • SPEEDING - 20 OVER - Allegheny: Client facing 4 points on license. Result: Negotiated plea to 5mph over, no points or suspension.
  • DRIVING WITH SUSPENDED LICENSE DUI RELATED - SUMMARY APPEAL - Washington: Client facing mandatory 60-day jail sentence. Result: Case dismissed. 
  • "HIT AND RUN" - ACCIDENT TO ATTENDED VEHICLE (M3) - Allegheny: Client facing criminal record and loss of license, max sentence of up to 1 year in jail. Result: Negotiated plea to traffic ticket with no points or suspension, misdemeanor charge withdrawn. 
  • TERRORISTIC THREATS (M1) - Allegheny: Client facing permanent criminal record and max sentence of up to 5 years in jail. Result: Negotiated plea to summary disorderly conduct for fines/costs only. 
  • STOP SIGN VIOLATION - Washington: Client facing 3 points on driver's license and possible suspension if convicted for accruing more than 6 points. Result: Not-guilty verdict. 
  • SPEEDING - 20MPH OVER - Allegheny: Client facing 4 points on driver's license. Result: 5-mph over, no points. 
  • STALKING (M1) AND SIMPLE ASSAULT (M2) - Allegheny: Client facing maximum sentence of up to 7 years in jail and permanent criminal record. Result: Preliminary hearing held in May. Court dismissed all misdemeanor charges in August, convicting instead on a summary defiant trespass offense for a fine only. 
  • SPEEDING - 17MPH OVER - Westmoreland: Client facing 3 points on driver's license. Result: Negotiated plea to 5mph over, eliminating points. 
  • UNDERAGE DRINKING - Washington: Client facing 90-day license suspension upon conviction. Result: Plea to disorderly conduct offense, eliminating license suspension. DC conviction to be appealed to Court of Common Pleas for possible withdrawal. 
  • AGGRAVATED ASSAULT ON POLICE OFFICER (F2), DRIVING UNDER THE INFLUENCE - REFUSAL (M1), RESISTING ARREST (M2), SIMPLE ASSAULT (M2) AND DISORDERLY CONDUCT (M3) - Armstrong: Client with no criminal history facing max sentence of up to 20 years in jail, mandatory minimum sentence of 90 days in jail on highest tier DUI offense, and potential status as convicted felon. Filed pretrial motions to suppress evidence and quash certain charges for a lack of evidence. Initial offer from prosecutor to felony and highest tier DUI offense, later amended after negotiations. Result: Aggravated assault charge withdrawn, plea to simple assault, resisting arrest, and DUI General Impairment negotiated for 5 days in jail, credit for time served, and 6 months of parole. 
  • MOTION TO LIFT/TRANSFER DETAINER - Allegheny: Client incarcerated for violating probation. Motion filed to seek client's release. Result: Motion granted, client released to inpatient rehab facility and then to be released home thereafter. 
  • PETITION TO FILE SUMMARY APPEAL NUNC PRO TUNC - Butler: Client entered guilty plea to excessive speeding violation  and failed to file summary appeal within 30 days, facing a 15-day driver's license suspension and 5 points. Petition requesting permission to file appeal presented to court. Result: Petition granted, client given opportunity to contest the excessive speeding violation. 
  • CARRYING FIREARM WITHOUT A LICENSE (F3), ACCIDENT WITH ATTENDED VEHICLE (M3) - Allegheny: Client facing maximum sentence of up to 8 years in prison and permanent criminal history. Result: Commonwealth withdrew case after defense objection to hearsay sustained. 

JULY 2015

  • THEFT BY UNLAWFUL TAKING (F3), ACCESS DEVICE FRAUD (F3) AND SIMPLE ASSAULT (M2) - Allegheny: Client with a clean record falsely accused of multiple criminal acts by former boyfriend. No offer was made on this case and the matter was listed for a non-jury trial. Defense prepared and filed multiple motions and compiled evidence establishing that the victim had an extensive criminal history, and that he was lying about the extent and severity of  the allegations. Result: Defense objected to Commonwealth's continuance request, which was denied. CHARGES WITHDRAWN AND CLIENT DISCHARGED FROM FURTHER PROSECUTION. 
  • SIMPLE ASSAULT AND INTIMIDATION OF A VICTIM (Allegheny): Client with clean record facing permanent criminal history and max sentence of up to 4 years in prison for false accusations. Result: NOT-GUILTY VERDICT AFTER TRIAL
  • PERSON NOT TO POSSESS FIREARM, CARRYING FIREARM WITHOUT A LICENSE AND TERRORISTIC THREATS (Allegheny): Client facing maximum sentence of up to 15 years in prison. Result: Charges dismissed at preliminary hearing due to Commonwealth's inability to proceed. 
  • SPEEDING (55+ MPH OVER) AND CARELESS DRIVING - Allegheny: Client stopped traveling 55mph+ over the speed limit, facing 8 points, potential 30-day license suspension, and departmental hearing with PennDOT. Result: Negotiated agreement for completion of safe driving classes for a 20mph over offense. 4 points on license without suspension or PennDOT hearing upon completion of agreement. 
  • DRIVING UNDER THE INFLUENCE OF ALCOHOL - HIGHEST TIER .16% AND ABOVE - Allegheny: Client facing permanent criminal record, 1 year license suspension and 72 hour mandatory minimum jail sentence. Result: Negotiated admission into the ARD program. No jail time, reduced 60 day license suspension, and charges to be dropped and expunged upon program completion.
  • DEFIANT TRESPASS (M3) AND DISORDERLY CONDUCT (M3) - Allegheny: College student with clean record facing permanent criminal record and up to 2 years in jail. Result: Community service agreement negotiated and completed, all charges dismissed and to be expunged in future.
  • SIMPLE ASSAULT (M2) AND HARASSMENT - Allegheny: Client with clean record facing permanent criminal record and max sentence of up to 2 years in jail. Result: After preliminary hearing concluded, MDJ dismissed the simple assault count and convicted client of summary harassment. Summary appeal is pending. 
  • SIMPLE ASSAULT BY PHYSICAL MENACE (M2) - Allegheny: Client facing criminal record and max sentence of up to 2 years in jail. Result: Motion to dismiss at MDJ granted, charges dismissed.
  • POSSESSION OF A CONTROLLED SUBSTANCE (M) AND POSSESSION OF DRUG PARAPHERNALIA (M) - Butler: Client facing maximum sentence of up to 4 years in jail and probation. Result: Negotiated misdemeanor paraphernalia plea at Magisterial District Court for fines and court costs only. No probation or jail time.
  • RESISTING ARREST (M2) and DISORDERLY CONDUCT (M3) - Allegheny: Two clients facing permanent criminal record, probation, and maximum sentence of up to 3 years in jail. Result: Negotiated community service agreement which was completed, all charges dismissed.
  • AGGRAVATED ASSAULT (F1), DUI - ACCIDENT (M), RECKLESSLY ENDANGERING ANOTHER PERSON (M2), ACCIDENT INVOLVING ATTENDED VEHICLE (M3) - Allegheny): Client facing maximum sentence of up to 23.5 years, with a standard range guideline sentence of 3-6 years for Aggravated Assault. Result: Aggravated Assault charge withdrawn, Plea to DUI and REAP charge for 4-day DUI Alternative to Jail program and probation.
  • ENDANGERING THE WELFARE OF A CHILD (F3 - Westmoreland): Client facing maximum sentence of up to 7 years in jail for second EWOC offense. Result: Negotiated plea to misdemeanor offense. 
  • POSSESSION OF A CONTROLLED SUBSTANCE AND DRUG PARAPHERNALIA (Allegheny): Client with clean record facing permanent criminal history and maximum sentence of up to 18 months in jail. Result: Charge reduced to summary disorderly conduct for fines and court costs only.
  • DRIVING ON A SUSPENDED LICENSE - DUI RELATED (Allegheny): Client appealed summary conviction, facing mandatory 60-day jail sentence, 12-month license suspension and $500 fine. Result: Appeal sustained, charge dismissed.
