Result: Negotiated agreement for client to complete community service in return for a future reduction to a summary disorderly conduct.

  • 2nd Offense DUI - Drugs, High Rate of Alcohol and General Impairment with Accident (Washington): Client facing mandatory minimum jail sentence of 90 days with a max sentence of up to 5 years in jail. Result: Negotiated plea agreement where client received 6-months of house arrest and 5 years of probation, avoiding incarceration.

  • DUI - High Rate of Alcohol (Washington): Client facing 48-hour mandatory minimum jail sentence, max sentence of up to 6 months in jail, a 12-month license suspension and permanent record upon conviction. Result: Negotiated admission into the ARD Program. Successful completion of the program will allow client to avoid jail time and a criminal conviction. License suspension reduced to 30 days.

  • Altered & Forged Documents and Driving on a Suspended License, DUI Related (Allegheny): Client facing max sentence of over 5 years in jail, mandatory minimum jail sentence of 60 days. Result: Negotiated reduction to summary disorderly conduct and driving on a suspended license, non-DUI related, avoiding all jail time.

  • Careless Driving (Allegheny): Client facing 3 points. Result: Negotiated reduction to offense carrying no points.

  • Underage Drinking (Allegheny): Client facing $500 fine plus court costs, and publicly searchable summary conviction that cannot be expunged until client turns 21 years of age. Result: Negotiated agreement for client to complete community service in return for a future withdrawal of charge.

  • Speeding 22mph School Zone (Beaver): Client facing 4 points and 1st offense conviction, which could trigger 60-day suspension if a future school zone conviction occurred. Result: Negotiated reduction to 5mph over in a non-school zone, avoiding points.

  • DUI - Minor (Allegheny): Client facing 72-hour mandatory minimum jail sentence, max sentence of up to 6 months in jail, a 12-month license suspension and permanent record upon conviction. Result: Negotiated admission into the ARD Program. Successful completion of the program will allow client to avoid jail time and a criminal conviction. License suspension reduced to 90 days.

Result: Negotiated tentative written plea offer for withdrawal of Possession of Controlled Substance offense, please to Marijuana/Paraphernalia offenses for 1 year of probation.

  • Theft by Unlawful Taking and 2x Access Device Fraud (Allegheny): Client facing max sentence of up to 12 years in jail and a permanent record. Result: Negotiated agreement for client to pay restitution in return for a reduction to 3x disorderly conduct summary offenses for fines/costs. All misdemeanor charges withdrawn at preliminary hearing.

  • Accident w/ Damage to Unattended Vehicle, Safe Speed, Failure to Stop & Render Aid, Seat Belt, Disregarding Traffic Lane (Westmoreland): Out-of-state CDL holder facing multiple CDL disqualifications/suspensions upon conviction. Result: Negotiated plea to 1x equipment violation only, all other charges withdrawn. No CDL disqualification or points.

  • Driving on a Suspended License (Allegheny): Client facing additional 12-month license suspension upon conviction along with a $200 fine. Result: Negotiated agreement for dismissal of charge.

NOVEMBER 2022

  • Possession of Marijuana and Drug Paraphernalia (Allegheny): Client facing max sentence of up to 13 months in jail and a permanent record. Result: Negotiated agreement for client to complete community service in return for a withdrawal.

  • Underage Drinking (Westmoreland): Client facing $500 fine plus court costs, and publicly searchable summary conviction that cannot be expunged until client turns 21 years of age. Result: Not guilty.

  • Recklessly Endangering Another Person (Allegheny): Client facing max sentence of up to 2 years in jail. Result: Negotiated agreement for client to complete counseling and firearms safety course in return for a future reduction to a summary disorderly conduct.

  • Summary Harassment (Allegheny): Client facing publicly searchable summary conviction that cannot be expunged for minimum period of 5 years, plus $300 fine and costs. Result: charge dismissed.

  • M3 Disorderly Conduct and M3 Furnishing Alcohol to Minors (Allegheny): Client facing max sentence of up to 2 years in jail and a permanent criminal record. Result: Negotiated agreement for client to complete community service in return for a full withdrawal of charges.

  • Underage Drinking and Disorderly Conduct (Indiana): Client facing summary conviction that cannot be expunged for minimum period of 5 years along with $800 in fines plus court costs. Result: Negotiated agreement for withdrawal of disorderly conduct offense and plea to underage drinking. Client eligible to expunge underage drinking offense upon turning 21 years of age. Fines reduced to $50 plus court costs.

  • 2x Stop Sign violations (Allegheny): Client plead guilty to two stop sign violations, not realizing that decision to plead guilty would lead to imposition of 6 points on driving record. Firm hired to file summary appeal. Result: Negotiated amendment of charges to alternative offense eliminating all points.

  • Speeding 31MPH over (Allegheny): Client facing 5 points on driving record, mandatory PennDOT Departmental hearing, and potential 15-day license suspension if convicted. Result: Negotiated reduction to 5mph over, avoiding all points, suspensions and PennDOT hearing.

  • F3 Endangering Welfare of Child, M3 Criminal Mischief, M3 Loitering and Prowling at Nighttime, DUI - Highest Rate of Alcohol (Allegheny): Client facing max sentence of up to 9.5 years in jail, a mandatory minimum 72-hour jail sentence, and a 12 month license suspension. Result: Negotiated amendment of F3 EWOC charge to M2 Recklessly Endangering Another Person offense. EWOC, criminal mischief and loitering charges all withdrawn at preliminary hearing. Outcome pending on DUI and REAP counts.

If convicted of 1st offense Fake ID charge, client could face a 3rd Degree Misdemeanor for a future offense.   • Simple Assault, M3 Disorderly Conduct and Harassment (Armstrong): Client facing max sentence of up to 3 years in jail and a permanent criminal record. Result: Negotiated agreement for client to complete anger management counseling in return for a future withdrawal of all charges.

  • Driving on a Suspended License (Butler): Client facing additional 12-month license suspension with a $200 fine plus court costs. Result: Negotiated reduction to Failure to Carry License offense, avoiding suspension and reducing fine to $25.

  • Driving at Safe Speed (Allegheny): CDL holder facing 3 points and potential loss of suspension of employment. Result: Negotiated agreement for dismissal of charge.

  • Protection from Abuse Order (Allegheny): Client facing imposition of 3-year PFA if act of abuse proven by Plaintiff at hearing. Result: Negotiated general continuance of temporary PFA for 6 months for client to complete counseling and avoid contact with Plaintiff. If compliant, PFA will be withdrawn after 6 months.

Result: Negotiated entry into Allegheny County’s DUI Court Program, where client placed on 18 months of house arrest and 42 months of probation.

  • 2x Terroristic Threats and 2x Simple Assault by Physical Menace (Lawrence): Client facing max sentence of up to 14 years in jail, a permanent criminal record, and requirement to provide a DNA sample upon conviction. Result: Charges withdrawn.

Result: Negotiated withdrawal of Reckless Driving offense in return for guilty plea to remaining violations. 3 points imposed, but no license suspension.

  • M1 Retail Theft (Allegheny): Client facing max sentence of up to 5 years in jail and a permanent criminal record. Result: Negotiated agreement for withdrawal of charge.

  • Speeding 32MPH and Careless Driving (Allegheny): For speeding offense, client facing 5 points, a mandatory PennDOT Departmental Hearing and potential 15-day license suspension. Client facing 3 points for Careless Driving offense. Result: Negotiated reduction of speed to 5mph over and careless to a traffic control devices violation. No points, PennDOT hearing or suspension.

  • Reckless Driving (Allegheny): Client paid off the fine for this offense at the magistrate’s office, not realizing that it carried a 6-month mandatory license suspension. Firm was hired to file summary appeal and request delay of license suspension pending the outcome. Result: Negotiated reduction to alternative traffic charge, eliminating the 6-month license suspension.

  • False Reports to Law Enforcement and Driving on a Suspended License (Allegheny): Client facing max sentence of up to 12 months in jail and a 12-month license suspension if convicted. Result: Negotiated withdrawal of False Reports charge and plea to a Failure to Carry License traffic offense, avoiding the license suspension.

  • Possession of a Controlled Substance and Drug Paraphernalia (Allegheny): Client facing max sentence of up to 2 years in jail and a permanent criminal record. Result: Negotiated plea agreement for 6-months of non-reporting Probation Without Verdict. Upon successful completion of probation, all criminal charges will be withdrawn and expunged from criminal record.

  • F1 Robbery, F1 Burglary, F2 Strangulation, M2 Simple Assault and M1 False Imprisonment (Allegheny): Client facing max sentence of up to 57 years in jail, a permanent criminal record, requirement to submit a DNA sample. Result: Negotiated agreement where Robbery, Burglary and Strangulation charges were withdrawn, and client admitted to ARD Program on Simple Assault and False Imprisonment charges for 2 years of probation. Upon successful completion of program, all charges will be withdrawn and expunged from criminal record.

  • DUI - Minor (Allegheny): Client facing mandatory minimum 72-hour jail sentence, max sentence of up to 6-months in jail, a 12-month license suspension and a permanent criminal record. Result: Negotiated admission into the ARD Program, which will allow client to avoid jail time and a criminal record upon completion of 12 months of probation. License suspension reduced to 90 days.

  • Indirect Criminal Contempt (Allegheny): Client facing max sentence of up to 6 months in jail and a permanent criminal record. Result: Charge was withdrawn by Commonwealth at ICC hearing.

  • Violating Weight/Size Limits (Allegheny): Trucker facing a $4,000 fine for exceeding weight limits. Result: Negotiated agreement to reduce fine in 1/2 to $2,000.

  • 2x Simple Assault and Harassment (Westmoreland): Client facing max sentence of up to 4 years in jail and a permanent criminal record. Result: Negotiated agreement for withdrawal of charges.

  • Speeding 36mph over (Westmoreland): Client plead guilty to speeding offense, not realizing that 5 points, a PennDOT Departmental hearing and potential 15-day license suspension would apply. Firm hired to file summary appeal of his traffic conviction. Result: Negotiated reduction to 20mph over. Reduces points down to 4, eliminates PennDOT hearing and license suspension.

  • Public Urination (Allegheny): Client facing publicly searchable local ordinance conviction with potential fines/costs exceeding $500. Result: Case dismissed.

  • Speeding 40+mph (Westmoreland): Client facing 5 points, PennDOT departmental hearing and potential 15-day license suspension, in addition to suspension for exceeding 6 points.   • 3x F3 Endangering Welfare of Child, DUI-Drugs 1st Offense Highest Tier (Allegheny): Client facing max sentence of up to 21.5 years in jail along with a permanent felony record. Result: Negotiated plea agreement where F3 EWOC charges were withdrawn, guilty plea to DUI only for the DUI Alternative to Jail Program and probation. Client eligible for partial expungement of F3 EWOC offenses and will become eligible for record sealing of DUI in 10 years.
