The results listed below are real case results on criminal and traffic cases handled by the Zuckerman Law Firm throughout Allegheny County and Western Pennsylvania in 2019. This list does not include results on every case handled by the firm. Names and case details are omitted to protect client confidentiality. DECEMBER 2019

  • 1st DUI Highest Tier (Armstrong): Client with past charges facing mandatory minimum 72 hour jail sentence, max of up to 6 months, and a 12 month license suspension. Result: Negotiated offer for entry into ARD program for 12 months of probation with a 60 day license suspension.

  • Underage Drinking (Cambria): Client facing publicly searchable conviction with max fines/costs of up to $450. Result: Negotiated agreement for client to complete 20 hours of community service in return for a future dismissal of the charge.

  • Public Drunkenness (Allegheny): Professional facing publicly searchable conviction with max fines/costs of up to $450. Result: Agreement reached for dismissal of charge.

  • Follow Too Closely, Unlawful Activities, 3x seatbelt violations (Allegheny): Client facing 3 points and multiple safety violations. Result: Following too closely and seatbelt violations dismissed. Guilty of unlawful activities for fine/costs only, no points.

  • Speeding 15mph over (Washington): CDL holder facing 3 points on driving record, likely insurance increases upon conviction. Result: Case dismissed.

  • Driving on a Suspended License and Careless Driving (Allegheny): Client represented self at magistrate level and convicted. Filed late summary appeal and retained firm for representation at summary appeal hearing. Result: Agreement negotiated for plea to Failure to Exhibit License upon demand and a traffic control devices violation. All license suspensions will be rescinded.

  • Corrupt Organization, Theft, Receiving Stolen Property, Access Device Fraud (Westmoreland): Client facing max sentence of over 15 years in jail, and guideline range sentence calling for state prison. Result: Attorney Milardo negotiated tentative written plea offer for plea to Theft/RSP for 6 months house arrest and probation.

  • 2 counts of Possession of Drug Paraphernalia (Allegheny): Client facing max of 2 years in jail. Result: Negotiated plea to summary disorderly conduct for fines/costs only.

  • Discharging Firearm into Occupied Structure and Recklessly Endangering Another Person (Washington): Client facing max sentence of up to 9 years in jail and permanent felony record. Result: Agreement finalized for entry into ARD program for 12 months of probation.

  • Overtaking School Bus (Allegheny): Client facing mandatory 60-day license suspension and 5 points upon conviction. Result: Negotiated agreement to amber signal violation, carrying no points or suspension.

  • Violating Size & Weight Limits (Allegheny): CDL Driver facing a $7500 fine upon conviction. Result: Waived client’s appearance in court. Negotiated resolution to reduce fine to $2,000, saving client approximately $5500 in total fines and costs.

  • Possession of Marijuana and Drug Paraphernalia (Indiana): College student facing max sentence of up to 13 months and permanent record. Result: Agreement reached for 30 days probation without verdict at magistrate level. If no violations, then client eligible for full expungement of charges.

  • Speeding 27 mph over (Allegheny): Client facing 5 points. Result: Agreement negotiated to 5mph over, no points.

  • Simple Assault (Washington): Client charged in multiple co-defendant altercation, facing up to 2 years in jail. Result: Tentative agreement negotiated for entry into ARD program, no jail time and charge dismissed upon successful completion

  • Speeding 26mph over, Careless and Safe Speed (Allegheny): Client facing up to 8 points on driving record, having to take PennDOT points exam. Result: Charges dismissed.

  • Summary Retail Theft (Indiana): Client facing publicly searchable conviction that cannot be expunged for minimum period of 5 years and fines/costs of approximately $450. Result: Attorney Milardo negotiated agreement for withdrawal of charge based upon payment of restitution.

  • Accident Involving Death or Personal Injury (Washington): Client facing max sentence of up to 5 years in jail and a 12-month license suspension upon conviction. Result: Negotiated agreement at magistrate level for client to plead guilty to summary disorderly conduct and traffic offense carrying points. Misdemeanor accident charge withdrawn.

  • Simple Assault & Harassment (Allegheny): Client charged in domestic incident facing max sentence of up to 2 years in jail. Result: Agreement reached for client to complete anger management course in return for full withdrawal of charges.

  • Fake ID (Allegheny): Client facing publicly searchable conviction that cannot be expunged for minimum period of 5 years and fines/costs of approximately $450. Result: Charge dismissed as a result of agreement reached on client’s behalf.

  • Speeding 33mph over (Westmoreland): Client facing 5 points and up to 30 days worth of license suspensions based upon excessive speed and exceeding 6 point threshold. Result: Attorney Milardo successfully argued for reduction to 6mph over, adding 2 points to driving records, but eliminating all license suspensions.

  • Motion to Modify Bond (Allegheny): Bail motion filed to pursue modifications to allow client to travel. Result: Motion granted.

  • Driving on a Suspended License (Allegheny): Client facing mandatory 60 day jail sentence upon conviction. Result: Client incarcerated for more than 60 days in another county. Agreement reached for concurrent jail time, so that no additional jail time will be served as a result of this case.

  • Insurance Fraud & Theft by Deception (Westmoreland): Client facing permanent criminal record and max sentence of up to 12 years in jail. Result: Negotiated tentative written agreement for entry into the ARD program.

  • PFA (Allegheny): Client facing publicly searchable PFA order. Result: Civil consent agreement reached by Attorney Milardo where PFA was dismissed.

  • Speeding 24mph over (Westmoreland): Client facing 5 points. Result: Plea agreement to 5mph reached. No Points.

  • Possession of a Controlled Substance & Drug Paraphernalia (Washington): Client facing maximum sentence of 13 months and permanent criminal record. Result: Negotiated reduction to a summary disorderly conduct for fines/costs only.

  • Driving on a Suspended License DUI Related (Allegheny): Client facing a mandatory 60-day jail sentence, 12 month license suspension and $500 fine upon conviction. Result: Negotiated agreement where client will be able to earn a dismissal of charge once license regained in spring of 2020.

NOVEMBER 2019

  • Simple Assault & Harassment (Allegheny): Client facing max sentence of over 2 years in jail and permanent record. Result: Agreement reached with DA and co-defendant’s lawyers where charges against all parties will be reduced to a summary disorderly conduct only.

  • Underage Drinking (Washington): Client facing publicly searchable conviction that cannot be expunged for minimum period of 5 years and fines/costs of approximately $450. Result: Charge withdrawn as a result of agreement reached where client completed underage drinking educational course.

  • Careless Driving & 3 other offenses (Washington): Client facing 3 points. Result: Agreement reached to avoid points.

  • DUI 1st Offense Highest Tier (Washington): Client facing permanent record and mandatory minimum jail sentence of 72 hours. Result: Case dismissed due to lack of evidence.

  • Accident with Unattended Vehicle, Safe Speed, 2x Other Traffic Violations (Beaver): Client facing 7 points on driving record, having to attend departmental hearing and take points based exam. Result: Negotiated plea agreement to safe speed violation and one other traffic offense. Total of 3 points.

  • M1 Retail Theft and Probation Violation (Allegheny & Westmoreland): Client facing a probation violation and max sentence of up to 5 years for the retail theft offense. Result: Negotiated agreement for dismissal of retail theft charge at preliminary hearing. Probation violation hearing cancelled and client discharged from probation.

  • Speeding 20mph over (Allegheny): Client facing 4 points on driving record. Result: Agreement reached for 5mph over no points.

  • Resisting Arrest, Possession of a Controlled Substance, Possession of Drug Paraphernalia and M3 Disorderly Conduct (Allegheny): Client facing a max sentence of up to 5 years in jail and a permanent record. Result: Plea agreement negotiated to one count of Possession of a Controlled Substance and Disorderly Conduct only for 12 months probation. Resisting and paraphernalia charges withdrawn. Client will qualify for record sealing in 10 years.

  • Possession of a Controlled Substance & Drug Paraphernalia (Allegheny): Repeat offender facing max sentence of up to 4 years in jail. Result: Agreement reached at magistrate level where client will complete drug and alcohol evaluation in return for reduction to a summary disorderly conduct offense.

  • Driving on a DUI Suspended License (Allegheny): Client facing 60-day mandatory jail sentence. Result: At summary appeals court, agreement for house arrest negotiated.

  • Possession of Drug Paraphernalia (Beaver): Client facing permanent record and max sentence of up to 1 year in jail. Result: Case dismissed.

  • DUI 2nd Offense Highest Tier (Allegheny): Client facing mandatory minimum 90-day jail sentence and max sentence of up to 5 years in jail. Result: Attorney Milardo negotiated agreement for 90 days of house arrest and 18 months probation.

  • Reckless Driving and Safe Speed (Allegheny): Client facing mandatory 6-month license suspension and 3 points upon conviction. Result: Negotiated plea agreement to an offense carrying no points or license suspension.

  • Two Cases - 5 total summary offenses, 2x Underage, 2x DC, 1x Public Drunkenness (Allegheny): Client facing fines/costs in excess of $1500 and publicly searchable record that cannot be expunged for minimum period of 5 years. Result: Attorney Milardo reached an agreement for client to complete 50 hours of community service in return for a dismissal of all charges at both cases.

  • DUI 1st Offense Highest Tier (Allegheny): Client facing parole violation if convicted promptly after charged. Result: Able to secure continuances so that client could max out federal probation before entering plea to offense for the DUI Alternative to Jail Program. No jail time or violation.

  • Theft of Services & Warrant (Allegheny): Client had an outstanding warrant for missing court date. Facing max sentence of up to 5 years in jail. Result: Attorney Milardo made arrangements to turn client into court and negotiate full withdrawal of charge on date of surrender in return for the full payment of restitution.

  • Reckless Driving and Safe Speed (Washington): Client facing mandatory 6-month license suspension and 3 points upon conviction. Result: Negotiated agreement for client to complete safe driving course in return for full withdrawal of charges.

  • Underage Drinking (Allegheny): Client facing max fines in excess of $450 and publicly searchable convictions that cannot be expunged for minimum of 5 years. Result: Attorney Milardo reached agreement for client to complete 20 hours of community service for a future withdrawal of charge.

  • Fake ID (Allegheny): Client facing max fines in excess of $450 and publicly searchable convictions that cannot be expunged for minimum of 5 years. Result: Charge dismissed.

  • Resisting Arrest, M3 Disorderly Conduct (Allegheny): College student facing max sentence of over 3 years in jail and permanent criminal record. Result: Negotiated agreement for client to complete Drug & Alcohol evaluation and complete 50 hours of community service in return for a future withdrawal of the charges.

  • Underage Drinking, Public Drunkenness and Disorderly Conduct (Washington): Client facing max fines in excess of $1300 and publicly searchable convictions that cannot be expunged for minimum of 5 years. Result: Attorney Milardo negotiated plea to local ordinance violation only. All crimes code charges withdrawn.

  • Public Drunkenness and Disorderly Conduct (Washington): Client facing max fines in excess of $900 and publicly searchable convictions that cannot be expunged for minimum of 5 years. Result: Attorney Milardo negotiated plea to local ordinance violation only. All crimes code charges withdrawn.

  • Public Urination (Allegheny): Client facing publicly searchable conviction that cannot be expunged for 5 years, and fines/costs of approximately $650. Result: Waived client’s appearance in court and reached agreement for dismissal of charge.

OCTOBER 2019

  • F3 Unlawful Sale/Transfer of Firearm and M3 Unsworn Falsification to Authorities (Butler): Client facing max sentence of up to 8 years in jail, permanent felony record if convicted. Result: Plea agreement reached for plea to M3 Unsworn Falsification offense at the magistrate’s office for $500 fine only. No probation, felony charge dropped.

  • Safe Speed, Following Too Closely and Careless Driving (Washington): Client facing total of up to 8 points on driving record if convicted. Result: Negotiated agreement to plead guilty to two offenses carrying no points.

  • Accident with Attended Vehicle (Allegheny): Client facing mandatory 12-month license suspension and max jail sentence of up to 12 months if convicted. Result: Agreement reached for client to pay restitution in return for reduction to a careless driving traffic ticket. Misdemeanor charge withdrawn, no license suspension.

  • Public Drunkneness, Disorderly Conduct, Defiant Trespass, Underage Drinking and Public Drunkenness (Washington): Client facing max fines in excess of $1500 and publicly searchable convictions that cannot be expunged for minimum of 5 years. Result: Negotiated plea to local ordinance violation only. All crimes code charges withdrawn.

  • Joint representation Harassment and Disorderly Conduct (Allegheny): Two relatives charged with harassment and disorderly conduct, facing publicly searchable convictions that cannot be expunged for 5 years, and up to $900 in fines. Result: Summary trial held, clients found not guilty of offenses.

  • Possession of a Controlled Substance (Allegheny): Client facing max sentence of up to 12 months in jail and permanent criminal conviction. Result: Case withdrawn at MDJ level due to insufficient evidence.

  • Reckless Driving and Safe Speed (Allegheny): Client facing 3 points on driving record and mandatory 6-month license suspension. Result: Negotiated agreement for client to complete safe driving class in return for plea to careless driving only. No license suspension, but 3 points imposed.

  • Retail Theft (Allegheny): Repeat offender facing max of up to 90 days in jail. Result: Negotiated agreement to complete class for withdrawal of charge.

  • Required Financial Responsibility (Washington): Client facing 90-day mandatory license suspension if convicted. Result: Agreement reached for charge to be withdrawn.

  • DUI Highest Tier (Beaver): Client facing mandatory 72-hour jail sentence, max of up to 6 months. Result: Agreement reached for plea to charge for 1 week of house arrest and probation.

  • Criminal Mischief, Public Drunkenness and Disorderly Conduct summaries (Allegheny): Client facing max fines/costs of over $1300, publicly searchable convictions that cannot be expunged for minimum of 5 years. Result: Negotiated agreement for client to complete community service and AA meetings for future withdrawal of charges.

  • Underage Drinking (Indiana): Client facing publicly searchable conviction that cannot be expunged until age 21, fines and costs of up to approximately $650. Result: Attorney Milardo successfully negotiated agreement to complete 10 hrs of community service for a withdrawal.

  • Fleeing & Eluding and DUI (Allegheny): Client facing felony charge of fleeing and eluding, with both charges carrying a max sentence of 7.5 years in jail, mandatory minimum 72 hour jail sentence, and 24-month license suspension. Result: Successfully negotiated entry into the ARD program, where client will avoid criminal record upon successful completion. License suspension of 60 days.

  • Simple Assault and Harassment (Allegheny): Client facing max sentence of up to 2 years in jail. Result: Case dismissed.

  • Possession of Marijuana and Drug Paraphernalia (Allegheny): Client facing max of up to 13 months of jail time. Result: Negotiated reduction to summary disorderly conduct offense.

  • 3rd and 4th Offense, Middle Tier DUIs, 2nd and 3rd Offense Driving on a Suspended License DUI Related with BAC of .02% or above (Westmoreland): On 3rd Offense DUI and 2nd Offense DUS DUI Case, client facing mandatory minimum sentence totaling 9-18 months. On 4th Offense DUI and 3rd Offense DUS DUI, client facing 12-24 month mandatory for the 4th DUI and 24-48 month mandatory for 3rd Offense DUS DUI charge. Total mandatory sentences faced 4.5-9 years of incarceration, with no eligibility for house arrest. Result: Negotiated agreement where both DUI DUS charges treated as 2nd offenses, reducing mandatories to 6-12 months each. Plea agreement for 1-7 years of incarceration, with both cases concurrent. Client eligible for parole after 1 year. Deal saved over 2.5 additional years of incarceration.

  • Driving on a Suspended License, Reckless Driving, Careless Driving (Washington): Client facing an additional 18-months of license suspensions after recently regaining license. Result: Charges dismissed.

  • Public Drunkenness (Allegheny): Client facing fines/costs of approximately $450 and summary conviction that cannot be expunged for minimum 5-year period. Result: Attorney Milardo negotiated agreement for client to complete community service for a full withdrawal of charges.

  • 1st Offense Highest Tier and 2nd Offense Highest Tier DUIs (Allegheny): Client facing a cumulative 93-day mandatory jail sentence, max sentence of up to 5.5 years in jail. Result: Attorney Milardo successfully resolved with total of 90 days house arrest and 2 years probation.

  • Simple Assault by Physical Menace, Recklessly Endangering Another Person and Terroristic Threats: Client facing permanent criminal record, max sentence of up to 9 years in jail. Deadly weapon enhanced guideline range of 7-14 months in jail. Result: JURY FOUND CLIENT NOT GUILTY ON ALL COUNTS!

  • Possession of Marijuana and Drug Paraphernalia (Allegheny): Client facing max of up to 13 months of jail time. Result: Negotiated agreement for client to complete drug and alcohol evaluation for withdrawal of charge. Outcome still pending.

  • 2nd DUI Highest Tier (Westmoreland): Client facing mandatory minimum 90 days of jail time and max of up to 5 years. Result: Negotiated plea agreement for 90 days house arrest and probation.

  • Driving on a DUI Suspended License (Washington): Client facing mandatory 60-day jail sentence, $500 fine and additional 12-month license suspension. Result: Reduction to driving on non-dui suspension, no jail time, fine reduced from $500 to $200.

  • Disorderly Conduct - 2 counts (Washington): Client facing fines/costs of up to $900 and summary conviction that cannot be expunged for minimum period of 5 years. Result: Waived client’s appearance in court and resolved with plea to local ordinance violation for minimal fine. No crimes code conviction.

SEPTEMBER 2019

  • Furnishing Alcohol to Minors (Allegheny): Client facing max sentence of up to 1 year in jail and permanent record. Result: Negotiated agreement for client to complete community service in return for reduction to summary disorderly conduct offense.

  • Simple Assault by Physical Menace, Terroristic Threats and Harassment (Allegheny): Client facing max sentence of up to 7 years in jail and permanent criminal record. Result: Negotiated agreement where client surrenders carry permit in return for reduction to a summary harassment. Misdemeanors dismissed and eligible for partial expungement.

  • Reckless Driving & Safe Speed (Westmoreland): Client facing 2 points and 6-month mandatory license suspension. Result: Attorney Milardo negotiated resolution with plea to safe speed violation only. 2 points imposed, but no license suspension.

  • Summary Harassment (Allegheny): Client facing fines/costs of approximately $450 and summary conviction that cannot be expunged for minimum 5-year period. Result: Trial held on the matter. Judge elected to delay verdict for 6 months and if no further contact, charge will be dismissed.

  • Driving on a Suspended License, DUI Related (Washington): Client facing 60-day mandatory jail sentence and 12-month suspension. Result: Negotiated reduction to 1501A Driving Without a License, to which there is no jail time or mandatory suspension for a first offense.

  • Driving on a Suspended License, DUI Related (Washington): Client facing 60-day mandatory jail sentence and 12-month suspension. Result: Negotiated agreement for continuance past client’s license eligibility date. If client regains license, charge will be dismissed.

  • Fake ID (Allegheny): Client facing summary conviction with fines/costs of approximately $650 and a record that cannot be expunged for minimum 5-year period. Result: Negotiated agreement for client to complete community service for future withdrawal of charge.

  • Careless Driving (Allegheny): Client facing 3 points on driving record. Result: Not guilty.

  • Speeding 35+ mph over (Allegheny): Client facing 5 points, mandatory Penndot departmental hearing and up to a 30-day license suspension for exceeding 31mph over and speeding in a work zone. Result: Attorney Milardo reached agreement for reduction to 15mph over in a non-work zone. Reduces points from 5 to 3, and eliminates license suspensions.

  • F3 Theft by Unlawful Taking and Receiving Stolen Property (Westmoreland): Client facing max sentence of up to 7 years in jail and permanent felony record. Result: Negotiated tentative agreement for client to enter ARD program and repay restitution. Final outcome pending.

  • Retail Theft (Allegheny): Client charged with summary retail theft facing max sentence of 90 days in jail and record that cannot be expunged for minimum period of 5 years. Result: Agreement reached for client to complete class for a dismissal of charge.

  • DUI - Highest Tier, 2nd Offense (Allegheny): Client facing mandatory minimum jail sentence of up to 90 days in jail and 5 year max. Result: Client bail revoked due to appearing in court intoxicated. On rescheduled sentencing date, Attorney Milardo successfully argued for release from jail, with balance of sentence to be served on house arrest.

  • Simple Assault and Strangulation (Allegheny): Client facing max sentence of up to 12 years in jail and permanent record. Result: Attorney Milardo successfully sought dismissal of charge

  • Bad Checks (Fayette): Client facing max sentence of up to 5 years in jail and permanent criminal record. Result: Negotiated Rule 586 settlement leading to dismissal of charge.

  • Driving on a Suspended License DUI Related (Allegheny): Client facing 60-day mandatory jail sentence and 12-month suspension. Result: Negotiated reduction to 1501A Driving Without a License, to which there is no jail time or mandatory suspension for a first offense.

  • Driving on a Suspended License DUI Related (Allegheny): Client facing 60-day mandatory jail sentence and 12-month suspension. Result: Advocated for dismissal of charge due to client regaining license.

  • DUI - 1st Offense, Highest Tier, Possession of a Controlled Substance x 2, Paraphernalia (Allegheny): Client facing max sentence of over 3.5 years in jail, mandatory minimum 72-hour jail sentence. Result: Negotiated plea agreement to DUI offense only for the DUI Alternative to Jail Program/DUI Hotel and probation.

  • Accident with Attended Vehicle (Allegheny): Client facing permanent misdemeanor record and max sentence of up to 1 year in jail and a 12 month license suspension. Result: Agreement reached for withdrawal of M3 charge and plea to traffic charge of Careless Driving.

  • Driving on a Suspended License DUI Related (Washington): Client facing 60-day mandatory jail sentence and 12-month suspension. Result: Negotiated reduction to 1501A Driving Without a License, to which there is no jail time or mandatory suspension for a first offense.

  • Simple Assault and Harassment (Allegheny): Client with no criminal record facing permanent record and max sentence of up to 27 months in jail. Result: Negotiated agreement to complete anger management program in return for a future withdrawal of all charges.

  • Defiant Trespass (Allegheny): Client facing summary conviction which cannot be expunged for minimum period of 5 years. Result: Agreement reached for dismissal of charges.

  • Probation Violation/Gagnon II (Allegheny): Client facing technical and conviction based probation violations. Result: Successfully argued for extension of probation instead of jail time.

  • Stalking, Defiant Trespass, M3 Disorderly Conduct (Butler): Client facing max sentence of up to 7 years in jail. Original plea offer for 3-6 months of jail time and 5 years probation. Result: Filed an Omnibus Pretrial Motion and Motion to Dismiss for violating client’s speedy trial rights. Received day of hearing plea offer to M3 Disorderly Conduct for 6 months of non-reporting probation, which client accepted.
