DECEMBER 2018

• Driving on a DUI Suspended License, Required Financial Responsibility, 3 other citations (Allegheny): Client facing cumulative 15 month license suspension. Result: Guilty plea to one count of Failure to exhibit license upon demand, for $25 fine and costs. All other citations dismissed. No license suspension or points.

• Gagnon I hearing (Allegheny): Client detained for multiple probation violations. Result: Released to inpatient rehab.

• Summary Retail Theft (Allegheny): Working professional facing publicly searchable theft conviction that cannot be expunged for minimum period of 5 years. Result: Charges dismissed.

• Overtaking School Bus (Allegheny): 5 points and 60-day license suspension. Result: Reduction to 3111A violation for no points or license suspension.

• Simple Assault (Allegheny): Facing max sentence of 2 years and permanent criminal record. Result: Attorney Milardo successfully pursued dismissal of charges at preliminary hearing.

• Underage Drinking (Allegheny): Client facing 90 day license suspension and publicly searchable conviction, max fine/costs over $600. Result: negotiated agreement to complete comm service for w/d.

Result: Careless driving causing SBI amended to regular careless driving, eliminating 90 day suspension. Found guilty of insurance violation, so 90 day suspension will apply at this offense.

• 2 cases - Driving on a DUI Suspended License (Allegheny): Client facing mandatory jail sentences of 60 days at each case. Result: Negotiated plea agreement at summary appeals court for a total of 60 days of house arrest.

• 20+ counts - Insurance Fraud and Acquisition of a Controlled Substance by Misrepresentation (Armstrong): Client charged with prescription medication diversion. Guideline range sentence carrying 7-15 years of incarceration. Max sentence of over 20 years. Result: Negotiated open plea to one count of Insurance Fraud and Acquisition by Misrepresentation with offense gravity score reduction from 13 down to 5. Filed sentencing memo on client’s behalf. At sentencing, court imposed a 2 year probationary period. No jail time.

• Speeding 32mph over (Washington): Client facing 5 points, mandatory PennDOT Departmental hearing and 15-day license suspension. Result: Negotiated reduction to 15mph over, carries 3 points but no suspension or departmental hearing.

• Access Device Fraud, Criminal Attempt - Theft, Identity Theft (Allegheny): Client facing max sentence of over 10 years in jail. Result: Felony charges withdrawn at preliminary hearing. Plea negotiated for 12 months of non-reporting probation.

• Aggravated Cruelty to Animals and Animal Cruelty (Allegheny): Client facing max sentence of up to 7 years in jail due to alleged neglect. Result: At preliminary hearing, Attorney Milardo successfully argued for dismissal of F3 Aggravated Cruelty offense. Client to face trial on Misdemeanor Animal Cruelty.

• Simple Assault & Harassment (Allegheny): Client with clean record facing max sentence of up to 2 years in jail and a permanent record. Result: Negotiated agreement for client to complete BIP for full withdrawal.

• DUI - Highest Tier 2nd Offense: 90-day mandatory jail sentence, max of up to 5 years. Result: Deal reached for 90 days of house arrest with work release and 18 months probation.

• Strangulation, Simple Assault & Harassment (Allegheny): Client facing max sentence of up to 12 years in jail and permanent felony record. Result: Agreement reached for client to complete anger management and alcohol counseling in return for full withdrawal of charges.

• DUI - Highest Tier (Cambria): 72-hour jail sentence, 12 month suspension, permanent record. Result: Attorney Milardo negotiated entry into ARD program, reducing license suspension to 30 days and no jail time.

• Overtaking School Bus (Allegheny): 5 points and 60-day suspension. Result: Reduction to 3111A violation, no points or suspension.

• Public Drunkenness (Allegheny): Client facing publicly searchable conviction and fines/costs exceeding $450. Result: Negotiated agreement for client to continue with alcohol treatment for future dismissal of charge.

• Speeding - 25 over (Butler): Client facing 5 points and consequences for exceeding 6 point threshold. Result: Attorney Milardo negotiated reduction to 10mph, reducing points from 5 down to 2, and keeping client from exceeding 6 point threshold.

• DUI - Middle Tier (Beaver): Client facing mandatory minimum 48 hour jail sentence, 12 month license suspension and permanent criminal record. Result: Negotiated offer for admission into ARD program, no jail time, 30 day license suspension and ability to expunge record in future.

• Driving on a Suspended License (Allegheny): College student found guilty at summary trial after representing himself. Retained firm to represent him at summary appeal with goal of eliminating 12 month license suspension. Result: Negotiated plea to Failure to Exhibit License Upon Demand, no license suspension and fine reduced from $200 to $25.

• Reckless Driving & Safe Speed (Allegheny): Client facing mandatory 6 month license suspension and 2 points on driving record. Result: Attorney Milardo argued for reduction of Reckless Driving to Careless Driving, guilty of Safe Speed. Total of 3 points imposed on driving record, but mandatory 6 month suspension eliminated.

• Retail Theft M1 (Allegheny): Repeat offender facing max sentence of up to 5 years in jail and first misdemeanor conviction. Result: Negotiated agreement for client to complete retail theft classes and community service in return for reduction to summary disorderly conduct for fines/costs only.

• Simple Assault, Possession of Marijuana (Westmoreland): Client with extensive criminal record facing max sentence of over 2 years in jail. Guideline range sentence including county jail time. Result: Attorney Milardo negotiated agreement for withdrawal of simple assault charge in return for guilty plea to paraphernalia for 6 months probation.

• Strangulation, Simple Assault, Harassment (Allegheny): Client facing max sentence of over 12 years, permanent felony record in connection with domestic incident. Result: Negotiated agreement for client to complete BIP program for full withdrawal of charges.

• 2nd DUI - Drugs, Possession of Controlled Substance, Accident with Attended Vehicle, Possession of Drug Paraphernalia (Allegheny): Client facing mandatory minimum jail sentence of 90 days, 3.5 years worth of license suspensions, and max sentence of up to 10 years. Result: Negotiated plea agreement to DUI and paraphernalia charges only for 90 days of house arrest and 18 months probation. License suspension reduced from 3.5 years down to 1.5 years. No jail time.

• Unlawful Sale/Transfer of Firearm and Unsworn Falsification to Authorities (Allegheny): Working professional facing a loss of employment and professional license, max sentence of up to 8 years in jail and a permanent felony record. Result: Negotiated agreement with DA supervisor for summary disorderly conduct, felony and misdemeanor firearms charges dismissed.

• Underage Drinking and Fake ID (Allegheny): Repeat offender facing 6 month license suspension. Result: Attorney Milardo reached agreement for client to plead guilty to summary disorderly conduct, eliminating all license suspensions.

• Underage Drinking (Allegheny): Client facing publicly searchable conviction and 90-day license suspension. Result: Negotiated agreement to complete community service for full withdrawal of charge.

• Speeding 23 mph over (Beaver): Client facing 4 points on driving record. Result: Case resolved for 0 points.

• Furnishing Alcohol to Minors (Allegheny): Client with no record facing max sentence of up to 1 year in jail, a 90-day license suspension and permanent criminal record. Result: Negotiated agreement for client to complete 30 hours of community service for full withdrawal of charges.

• Forgery, Theft by Deception, Access Device Fraud (Allegheny): Client facing max sentence in excess of 10 year on multiple financial offenses. Result: DA’s office originally unwilling to resolve case at magistrate level. Filed pretrial motion to challenge validity of search. On motion hearing date, District Attorney’s office negotiated offer for plea to summary disorderly conduct for fines and costs only. All misdemeanor and felony charges dismissed!

• Probation Violation Hearing (Westmoreland): Client facing probation violation hearing on financial crimes offense. Result: Successfully argued to close interest on case.

• Driving on DUI Suspended License (Allegheny): Client facing 60-day mandatory jail sentence and $500 fine. Result: Negotiated reduction to Driving on Non-DUI Suspended License, $200 fine.

• Bail Motion (Allegheny): Client denied bond on an aggravated assault case. Result: Successfully argued for imposition of non-monetary bond.

• Simple Assault by Physical Menace (Beaver): Client with no prior record facing max sentence of up to 2 years in jail and a permanent criminal record. Result: Attorney Milardo persuaded ADA to drop charges based upon likelihood of success on self-defense claim.

• 2nd DUI - Highest Tier (Fayette): Client facing mandatory minimum 90-day jail sentence and max of up to 5 years in jail. Result: Attorney Milardo negotiated plea for 6 months house arrest and probation.

• Unlawful Sale/Transfer of Firearm and Unsworn Falsification (Allegheny): Client facing max sentence of up to 8 years in connection with allegation that he falsified firearms purchase paperwork. Result: Case dismissed at preliminary hearing.

• Resisting Arrest, Defiant Trespass and M3 Disorderly Conduct (Allegheny): Client with no prior record facing max sentence of up to 4 years in jail and permanent criminal record. Result: Negotiated reduction to summary disorderly conduct offense.

• Summary Retail Theft (Allegheny): Client facing max of 90 days, $450+ in fines/court costs and retail theft conviction on criminal record. Result: Successfully argued for not guilty verdict based upon insufficient evidence.

• Aggravated Assault on Police Officer, Simple Assault, Resisting Arrest (Washington): Client with no prior criminal record facing permanent convicted felon status and max sentence of over 12 years of incarceration. Result: Negotiated and finalized entry into ARD program for 12 months of probation on misdemeanor offense only.

• Simple Assault (Allegheny): Client facing max sentence of up to 2 years in domestic dispute. Result: Case dismissed.

• Terroristic Threats, M3 Disorderly Conduct, and Public Drunkenness (Allegheny): Facing max sentence of up to 6 years and 3 months of incarceration/probation and a permanent criminal record. Result: Successfully argued for dismissal based upon witness failure to appear in court.

• Overtaking School Bus (Allegheny): Client facing mandatory 60-day license suspension and 5 points on driving record. Result: Charge reduced to an amber signal violation, eliminating all points and suspensions.

• Speeding 37mph over (Allegheny): Client who frequently travels for work facing 5 points, a 15-day mandatory license suspension, PennDOT departmental hearing and PennDOT points exam if convicted. Result: Negotiated reduction of speed to 9mph over, carrying 2 points but no license suspension, PennDOT hearing or exam.

• Possession of Marijuana and Drug Paraphernalia (Allegheny): Business professional facing max sentence of up to 13 months worth of jail/probation, permanent misdemeanor record, and a 6-month mandatory license suspension. Result: Negotiated agreement for client to complete 20 hours of community service for full case withdrawal.

• Driving on a DUI Suspended License (Washington): Client facing 60-day mandatory jail sentence and 12-month license suspension, with a $500 fine. Result: Attorney Milardo negotiated reduction to 1543A Driving on a Non-DUI Suspended license, eliminating 60-day jail sentence. Resolution does add 12 month suspension to driving record.

• Driving Without a License (Allegheny): Client missed magistrate hearing for Driving Without a License offense. Due to this being a 2nd conviction under Section 1501A, a mandatory 6-month license suspension was imposed. Result: Case dismissed, suspension to be lifted.

• Overtaking School Bus (Allegheny): Single parent facing a mandatory 60-day license suspension and 5 points on driving record. Result: Attorney Milardo successfully argued for reduction to Traffic Control Devices violation for no points or suspension.

• Possession of Marijuana and Drug Paraphernalia (Allegheny): Client facing max sentence of up to 13 months worth of jail/probation, permanent misdemeanor record, and a 6-month mandatory license suspension. Result: Negotiated reduction to summary disorderly conduct offense at magistrate level for fines/costs only.

• Possession of a Controlled Substance and Drug Paraphernalia (Allegheny): Client facing max sentence of up to 2 years of jail/probation, permanent misdemeanor record, and a 6-month mandatory license suspension. Result: Negotiated reduction to summary disorderly conduct offense at magistrate level for fines/costs only.

• Public Drunkenness, Disorderly Conduct and Littering (Allegheny): Two college students applying to graduate school facing publicly searchable summary convictions and fines totaling in excess of $1,000 each. Result: During hearing, successfully argued for dismissal of all charges based upon completion of community service.

OCTOBER 2018

• Underage Drinking - 3 clients (Washington): 3 clients charged in connection with a single incident of underage drinking, facing summary conviction, 90-day license suspension and fines/costs of approximately $650. Result: Waived clients appearance in court due to out of state residency. Attorney Milardo successfully reached resolution where clients found guilty of a local ordinance glass bottles violation. No license suspension or summary conviction, fine reduced to approximately $200.

• Summary Defiant Trespass - 2 citations (Washington): Client charged in connection with two separate instances of appearing at Meadows Casino after being placed on a company-wide trespass list at an out of state casino. Result: At magistrate level, client found not guilty of one offense but guilty of the other. Appeal on guilty verdict filed. At summary appeals court, hearing held where the court found the Defendant not guilty of trespass for lacking knowledge that prior ban included Meadows Casino.

• Driving on a DUI Suspended License (Westmoreland): Client facing 60-day mandatory jail sentence and additional 12-month license suspension. Result: Case postponed for approximately 7 months. Client pursued a license suspension credit appeal hearing with PennDOT and was granted credit towards license suspension. As a result, client became eligible to regain driving privileges and case was dismissed due to the fact that client should not have been suspended at the time of the offense.

• Harassment and Criminal Mischief (Armstrong): Client accused of harassment, a summary offense alleging violent behavior, in addition to criminal mischief based upon a dispute between neighbors. Result: Attorney Milardo litigated summary trial, where client was found NOT GUILTY of harassment, but guilty of criminal mischief and ordered to pay restitution. No appeal to be filed, as parties satisfied with verdict.

• Underage Drinking (Allegheny) - 2 clients charged with underage drinking facing 90-day license suspension and publicly searchable summary conviction, along with fines/costs of up to approx. $650. Result: Attorney Milardo reached agreement for clients to complete community service for withdrawal of charges.

• Public Drunkenness (Allegheny): Working professional facing publicly searchable summary conviction and max fine/costs of up to $450. Result: Attorney Milardo negotiated agreement for client to complete community service for full withdrawal.

• Insurance Fraud - 2 counts of F3 and M1 (Allegheny): Client facing max sentence of up to 7 years of jail/probation and a permanent felony record. Result: Negotiated withdrawal of criminal charges in return for client paying an agreed upon civil demand amount of $500.

• Access Device Fraud, Conspiracy and Theft by Unlawful Taking (Allegheny): Client facing max sentence of up to 10 years in jail/probation and permanent criminal record. Result: Agreement negotiated where all offenses withdrawn in return for guilty plea to summary disorderly conduct for fines/costs only.

• Resisting Arrest, M3 Defiant Trespass, Summary Disorderly Conduct and Summary Public Drunkenness (Allegheny): Client facing max sentence of up to 3.5 years of incarceration/probation and a misdemeanor conviction on criminal record. Result: Negotiated agreement at preliminary hearing where misdemeanor resisting arrest and trespass offenses were withdrawn, client entered guilty plea to summary disorderly conduct and public drunkenness for fines/costs.

• Public Drunkenness and Obstructing Highways (Allegheny): Client with no prior offenses facing summary convictions and publicly searchable record. Result: Agreement negotiated for client to complete community service for dismissal of charges.

• Reckless Driving (Allegheny): Client plead guilty to offense at magistrate level, not realizing offense carried 6-month license suspension. Firm hired to handle summary appeal. Result: Case dismissed, suspension to be rescinded.

• Driving on Suspended License DUI Related (Washington): Client facing 60-day mandatory minimum jail sentence, max of 90 days and a $500 fine. Result: Attorney Milardo negotiated resolution to a Driving on a Non-DUI suspended license under Section 1543A, eliminating jail time. Fine reduced from $500 to $200.

• Use of Fictitious Registration, Forgery, and Identity Theft (Allegheny): Client with no prior record facing up to 12 years of jail/probation and permanent misdemeanor record. Result: Negotiated a Probation Without Verdict plea to use of fictitious registration offenses, for 1 year of probation. If client successfully completes probation, there will be no conviction on record and charges will be expunged. Forgery and ID Theft charges withdrawn.

• Furnishing Alcohol to Minors (Allegheny): Student facing max sentence of up to 1 year of probation, mandatory 6-month license suspension and permanent record. Result: Negotiated agreement for client to complete community service in return for full case withdrawal.

• Aggravated Assault, Terroristic Threats, Possession of Instrument of a Crime & Victim/Witness Intimidation - 2 cases (Allegheny): Client facing permanent felony record with maximum jail sentence exceeding 20 years for two separate cases. Result: Charges withdrawn.

• Gagnon II Hearing (Allegheny): Client with multiple probation violations for prior theft cases. Result: Attorney Milardo successfully negotiated extension of probation in lieu of jail time.

• Careless Driving Causing Serious Bodily Injury, Traffic Control Devices and Inspection (Westmoreland): Client convicted at magistrate level and hired firm to file summary appeal. Facing 90-day mandatory license suspension for careless driving causing serious bodily injury. Result: Negotiated withdrawal of careless driving SBI offense, guilty plea to other two charges. No points or license suspension .

• Reckless Driving (Westmoreland): Client convicted at magistrate level after representing himself. A 5-year habitual offender license suspension was imposed, along with the standard 6 month suspension for reckless driving for a total of 5.5 years worth of license suspensions. Firm hired for summary appeal. Result: Negotiated agreement for charge to be amended to careless driving, carrying 3 points but eliminating all license suspensions.

• Public Drunkenness and Public Urination (Allegheny): Client facing publicly searchable convictions for summary offenses along with up to $900 in fines and court costs. Result: Case dismissed.

• Retail Theft (Butler): Client with no prior record facing summary retail theft conviction that cannot be expunged for minimum period of 5 years. Result: Attorney Milardo negotiated agreement for client to complete retail theft education course for full withdrawal.

• Bad Checks (Butler): Client with prior offenses facing max sentence of up to 5 years of jail/probation and misdemeanor conviction on record. Result: Attorney Milardo negotiated guilty plea to summary bad checks offense for fines/costs/restitution only.

• Possession of Marijuana & Drug Paraphernalia (Allegheny): Client facing max of up to 13 months of jail/probation and 6-month license suspension upon conviction. Result: Negotiated agreement at MDJ level for client to complete 20 hours of community service for full withdrawal of charges.

• Public Drunkenness & Disorderly Conduct (Allegheny): Client facing potential probation violation out of county if convicted. Also facing $900+ in fines/costs. Result: Attorney Milardo reached agreement for client to complete community service for withdrawal of charges.

• Driving on DUI Suspended License (Washington): Client facing 12-month additional suspension along with 60 day mandatory jail sentence. Result: At hearing, successfully argued for reduction to a Driving Without License offense, eliminating all jail time.

• Overtaking School Bus (Allegheny): Client facing 60 day license suspension and 5 points. Result: Attorney Milardo negotiated reduction to traffic control devices, eliminating points and license suspension.

• Racing on Highways & Speeding 32 mph over (Armstrong): Client facing 6 month license suspension for racing offense, 5 points and a 15-day license suspension for speeding. Result: Not guilty of racing, guilty of 25mph over. 5 points imposed but no license suspension.

• Racing on Highways & Inspection (Armstrong): Client facing 6 month license suspension for racing offense. Result: Not guilty of racing offense, guilty of inspection for fines only.

• Criminal Attempt - Theft from Motor Vehicle and Loitering & Prowling at Nighttime (Allegheny): Client facing max sentence of up to 3 years in jail and misdemeanor convictions on record. Result: Negotiated plea to summary criminal mischief and disorderly conduct for fines/costs only. All misdemeanors withdrawn.

• Reckless Driving and Overtaking School Bus (Allegheny): Client facing total of 8 months worth of license suspensions and 5 points. Result: Attorney Milardo negotiated reduction to careless driving and traffic control devices offenses, eliminating all license suspensions and reducing points from 5 to 3.

• Carrying Firearm Without License (Allegheny): Client facing M1 offense who had carry permit in another state that does not have reciprocity with PA. Facing max sentence of up to 5 years in jail. Result: Commonwealth agreed to withdraw charges based upon misunderstanding by client.

• Simple Assault (Allegheny): Client with no criminal history facing max sentence of up to 2 years and permanent criminal record. Result: Case withdrawn by commonwealth due to insufficient evidence.

• Fake ID (Allegheny): Out of state client facing 90-day license suspension and conviction on criminal history. Result: Negotiated agreement whereby client completed 30 hours of community service for case dismissal.

• Animal Cruelty (Allegheny): Client with no criminal history facing summary animal cruelty offense based upon claim that pet was left in vehicle too long. Result: Negotiated agreement for client to complete 20 hours of community service with a pet shelter for a future dismissal of charge.

• Reckless Driving and Failure to Obey Person Directing Traffic (Allegheny): Client represented herself at magistrate level and was found guilty. Firm retained to file summary appeal and delay license suspension for reckless driving offense. If appeal unsuccessful, then 6-month license suspension and 3 points will remain on driving record. Result: Case dismissed.

• Motion to Transfer Detainer (Allegheny): Client being detained due to pending criminal charges. Court initially denied request to lift/transfer detainer after Gagnon 1 hearing. Firm retained to file motion to transfer detainer. Result: Motion to lift detainer for outright release home was denied. Motion to transfer detainer to alternative housing was granted.

SEPTEMBER 2018

• Simple Assault (Allegheny): Client facing max sentence of up to 2 years in jail and permanent criminal record. Result: Negotiated agreement for client to complete counseling in return for case withdrawal.

• Disorderly Conduct and Public Drunkenness (Allegheny): Client cited in connection with a fight, facing publicly searchable conviction with fines in excess of $900. Result: Case dismissed.

• Driving on DUI Related Suspension (Washington): Client facing 60 day mandatory jail sentence. Result: Attorney Milardo successfully argued for imposition of house arrest at summary appeals court.

• Safe Speed (Allegheny): CDL driver facing 2 point offense. Convicted at magistrate level when representing himself and firm hired for summary appeal. Result: Case dismissed.

• DUI - 1st Offense, Highest Tier (Cambria): Client facing 72 hour mandatory minimum jail sentence, 6 month maximum and a 12 month license suspension. Result: Attorney Milardo negotiated agreement for entry into ARD program, eliminating jail time and reducing license suspension to 60 hours. Further negotiations occurred, where DA’s office agreed to reduce license suspension to 30 days.

• 3 clients - Underage Drinking (Washington): Multiple co-defendant clients charged with underage drinking at event occurring at First Niagara Pavilion facing 6 month license suspensions and publicly searchable conviction. Result: Waived court appearance for clients. Attorney Milardo negotiated reduction of underage drinking offenses to local ordinance violations only, which are not crimes code offenses. No license suspension.

• Driving on DUI Suspended License (Allegheny): Client who regained driving privileges after being cited facing additional 12 month license suspension in addition to a 60 day mandatory jail sentence. Result: Citation dismissed.

• Possession of a Controlled Substance and Paraphernalia (Allegheny): Client represented himself at preliminary hearing and waived charges to court. Charged with slightly more than a small amount of marijuana, facing cumulative maximum of 2 years of incarceration and a 6 month license suspension. Result: Negotiated plea to 2 counts of summary disorderly conduct for fines and court costs only.

• 2nd Offense, Highest Tier DUI, with 3rd overall lifetime offense (Fayette): Client facing mandatory minimum of 90 days incarceration. Result: Attorney Milardo negotiated agreement for 90 days of house arrest.

• Driving on DUI Suspended License (Butler): Client who regained driving privileges after being cited facing additional 12 month license suspension in addition to a 60 day mandatory jail sentence. Result: Negotiated reduction to 1511A offense, carrying no jail time, suspension or points. Fine reduced from $500 to $25.

• Underage Drinking (Allegheny): Client facing 90 day license suspension and publicly searchable conviction. Result: Case dismissed.

• Possession of Marijuana and Paraphernalia (Allegheny): Client facing a probation violation if prosecuted past preliminary hearing for offense, in addition to 13 months of probation and a 6 month license suspension.
