DECEMBER 2017

  • Reckless Driving (Allegheny): Professional driver facing loss of employment due to 6 month license suspension upon conviction. Result: Negotiated reduction to Traffic Control devices violation, carrying no points or license suspension. 
  • Underage Drinking (Allegheny): Client facing 90 day license suspension and criminal record that cannot be expunged until client turns 21. Result: Case dismissed.
  • Possession of Small Amount of Marijuana and Drug Paraphernalia (Westmoreland): Client facing 6 month license suspension, loss of employment and max sentence of up to 13 months of jail or probation. esult: Negotiated probation without verdict offer for 6 months of probation and no license suspension. 
  • Summary Retail Theft (Beaver): Client with no prior criminal record facing criminal record that cannot be expunged for 5 years and fines/costs of up to $450. esult: Client completed retail theft education course, successfully argued for dismissal on status conference date. 
  • Driving on DUI Suspended License (Allegheny): Client close to regaining driving privileges, facing 60 day mandatory and an additional 12 months added onto existing suspension. Result: Negotiated reduction to Driving Without License charge, eliminating jail time and suspension. 
  • DUI - Middle Tier (Washington): Client with clean record facing 12 month license suspension, 48 hour mandatory jail sentence and loss of employment with any license suspension. Result: Initial offer for entry into ARD program on middle tier offense for 30 day license suspension. On hearing date, successfully argued to judge for entry into ARD on a general impairment offense carrying no license suspension, which effectively saved client's job. 
  • Simple Assault (Beaver): Client with clean record facing criminal record and max sentence of up to 2 years of jail or probation. Result: negotiated entry into the ARD program for 9 months of probation. 
  • Careless Driving (Allegheny): Facing 3 points. Result: Negotiated reduction to offense carrying 0 points. 
  • Reckless Driving, Speeding 47 over, Safe Speed (Westmoreland): Client facing 7 months worth of license suspensions, 5 points, in addition to sanctions for exceeding 6 points on driving record. Result: Negotiated reduction to 15mph over and traffic control devices violation, reducing points from 5 to 3, keeping client under 6 point threshold, and eliminating all license suspensions. 
  • Underage Drinking (Allegheny): Client facing 90 day license suspension and criminal record that cannot be expunged until client turns 21 years of age. Result: Negotiated agreement to complete community service for full withdrawal of case. 
  • Unlawful Sale/Transfer of Firearm and Unsworn Falsification (Allegheny): Client facing up to 8 years in jail in connection with firearm purchase application errors. Result: Case dismissed per agreement with DA's office.

  • Disorderly Conduct and Public Drunkenness (Allegheny): Client involved in physical altercation facing criminal record for minimum period of 5 years and fines/costs of over $900. Result: Negotiated agreement to complete 10 hours of community service for withdrawal. 
  • Accident Involving Damage to Unattended Property (Allegheny): Client facing 4 points. Result: Negotiated reduction to traffic control devices, eliminating points. 
  • Overtaking School Bus (Allegheny): Client facing 5 points and 60 day license suspension. Result: Negotiated reduction to unlawful activities violation, eliminating points and suspension. 
  • DUI - Highest Tier (Allegheny): Client was revoked twice from ARD program for various violations. Had warrant for arrest for missing probation violation hearing. Result: Argued for release from incarceration. Re-negotiated entry into ARD program. Client successfully discharged from program.

  • Tampering with Evidence, 2x Possession of a Controlled Substance and Possession of Drug Paraphernalia (Lawrence): Client facing max sentence of up to 9 years in jail and a 36 month license suspension. Result: Negotiated guilty plea to Possession of Drug Paraphernalia at magistrate's office, MDJ took plea imposed fines/costs only.

  • Reckless Driving, Safe Speed and Careless Driving (Allegheny): CDL driver facing serious CDL violation for reckless driving, a 6-month license suspension and 3 points on driving record. Result: Negotiated plea to a single Traffic Control Devices violation, eliminating all suspensions and points. Plea has no impact on CDL status. 
  • Public Drunkenness (Allegheny): Client has pending personal injury case against driver who struck him in intersection, with a conviction possibly having negative consequences upon litigation. Result: Client found not guilty of public drunkenness. 
  • Underage Drinking (Allegheny): Client facing max fine of up to $500, a 90-day license suspension and conviction on public record search. Result: Negotiated agreement to complete community service for future withdrawal of charge. 

OCTOBER 2017

  • Fleeing and Eluding (F3) and Driving Under Influence of Drugs (Allegheny): Client with clean record facing permanent felony record, mandatory jail sentence of 72 hours, max of up to 7.5 years, and a mandatory 24-month license suspension upon conviction. Result: Negotiated entry into the ARD program for 2 years of probation and no jail time. License suspension reduced to 2 months. Upon successful completion, charges to be dismissed and expunged from record. 
  • Prostitution (Allegheny): Client on temporary visa facing potential deportation and permanent criminal record. Result: negotiated reduction to summary disorderly conduct, a non-deportable offense, for fines/costs only.
  • 30+ counts of Corruption of Minors (Indiana): Client accused of over 30 counts in connection with allegation of sexual conduct with a minor. Facing a max sentence of up to 5 years at each count, and a guideline range sentence of 3-6 months at each count. Result: Negotiated plea to 3 counts of Corruption of Minors, for no Megan's Law registration. Judge imposed 6-23 month period of county jail incarceration with permission for work release. 
  • 70 counts of Felony Possession With Intent to Deliver and Simple Possession (Washington): Client overcharged by police officer in connection with heroin possession facing significant jail time. Result: Negotiated tentative plea offer to one count of Possession of a Controlled Substance for 12 months probation. All felony charges to be dropped. 
  • Terroristic Threats, Endangering Welfare of Child, Harassment (Lawrence): Client with clean record facing max of up to 11 years and 3 months of jail/probation and a permanent criminal record. Result: Negotiated tentative plea offer where EWOC charge dismissed and client to enter ARD program for 2 years of probation. Successful completion will lead to dismissal of charges. 
  • DUI (Allegheny): Client incarcerated with multiple outstanding cases facing mandatory 72 hour jail sentence and max of up to 6 months. Result: Negotiated agreement to take 3 days credit for time serve, preserving jail credit towards other cases. Paroled after 3 days and 6 months probation. 
  • Overtaking School Bus (Allegheny): Client represented self at summary trial and was convicted, facing 60-day mandatory license suspension and 5 points. Hired firm to file appeal. Result: Successfully argued for reduction of offense to a Traffic Control Devices violation, eliminating 5 points and 60 day suspension. 
  • Exceeding Maximum Speed by 31mph (Allegheny): Client plead guilty to citation not realizing it carried 5 points and a 15 day suspension. Retained firm to file summary appeal. Result: Negotiated reduction to 5 mph over, carrying no points or license suspension. 
  • Underage Drinking (Allegheny): Client facing max fine of up to $500, a 90-day license suspension and conviction on public record search. Result: Negotiated agreement to complete community service and underage drinking course for future withdrawal of charge. 
  • 2 Underage Drinking Cases (Allegheny): Client facing max fine of over $1000 along with a cumulative 15-months worth of license suspensions. Result: Negotiated agreement to complete community service and underage drinking course for dismissal of one case. Guilty plea to 2nd case with summary appeal pending. Successful completion will reduce license suspension by 12 months and fines by $500. 
  • Driving on a Suspended License DUI Related (Allegheny): Client facing mandatory $500 fine, 60-day jail sentence, max of up to 90 days of jail time, and an additional 12 month suspension. esult: Negotiated reduction to Driving Without a License offense, eliminating mandatory jail time, reducing suspension to a max of 6 months and reducing fine to $200. 
  • Driving on a Suspended License DUI Related (Allegheny): Client facing mandatory $500 fine, 60-day jail sentence, max of up to 90 days of jail time, and an additional 12 month suspension. esult: Negotiated reduction to a non-DUI related suspension offense, eliminating mandatory jail time and reducing fine to $200.

  • Underage Drinking (Allegheny): Client facing max fine of up to $500, a 90-day license suspension and conviction on public record search. Result: Negotiated agreement to complete community service for future withdrawal of charge. 
  • Underage Drinking (Washington): Client facing max fine of up to $500 plus court costs and a 90-day license suspension. esult: Negotiated reduction to non-criminal local ordinance violation, eliminating license suspension. 
  • Criminal Mischief, Disorderly Conduct and Public Drunkenness (Allegheny): Client charged with multiple summary offenses facing max of up to 9 months in jail and over $1,000 in fines/costs. Result: Negotiated withdrawal of criminal mischief and public drunkenness charges, plea to summary DC only for $450 worth of fines/costs. 
  • DUI Drugs (Allegheny): Client with prior out of state DUI initially charged with 2nd DUI offense, facing 90 day mandatory jail sentence and max of up to 5 years. Result: Further research into criminal record revealed conviction for a wet reckless driving offense in another state, making this a 1st offense DUI. Cleared out of state warrant on this case. Thereafter, negotiated admission into the ARD program, which will lead to record expungement upon program completion. No jail time and 12 months probation. 
  • Speeding 31mph over (Butler): Junior Driver facing a cumulative 105 day license suspension and 5 points for an excessive speed conviction. Result: Negotiated reduction to 10mph over, reducing points from 5 to 2 and eliminating license suspension.  
  • Reckless Driving (Allegheny): Client facing 6-month license suspension upon conviction. esult: Negotiated reduction to Careless Driving offense, a 3-point offense. Resolution eliminates license suspension. 
  • DUI and Reckless Driving (Allegheny): Client facing 72-hour mandatory sentence, an 18-month license suspension and up to 6 months of probation. Result: Charges dismissed, laboratory results negative for alcohol or drugs. 
  • Simple Assault & Possession (Allegheny): Client with clean record facing max of up to 25 months of jail/probation and 6-month license suspension. Result: Simple assault dismissed, marijuana charge amended to summary disorderly conduct for fines/costs only. 
  • Possession of Marijuana (Beaver): Client facing max sentence of up to 30 days and 6-month license suspension. Result: Negotiated reduction to a disorderly conduct offense for fines and court costs only. 

SEPTEMBER 2017

  • Possession of Marijuana (Allegheny): Individual on expired visa facing deportation for criminal violation. Result: Negotiated reduction to a disorderly conduct offense for time served, a non-deportable offense. Court would not agree for full dismissal. 
  • Speeding 20 over (Washington): Client facing 4 points on driving record. Result: Negotiated agreement to Traffic Control Devices, a 0 point offense.
  • Possession of Marijuana and Drug Paraphernalia (Allegheny): Client on probation facing probation violation and up to 13 months of jail time, on top of 12 month license suspension. Result: Negotiated reduction to summary disorderly conduct for fines/costs only. No probation violation for misdemeanors. 
  • Underage Drinking (Washington): Repeat offender facing 90-day license suspension and criminal record. Result: Charge reduced to local ordinance violation for glass containers, a non-criminal violation eliminating license suspension. 
  • Reckless Driving and Speeding 55mph over (Allegheny): CDL holder facing major CDL violation, mandatory license suspension of 6.5 months, and 5 points on driving record. esult: Client represented himself at magistrate's office and convicted of all charges. Our office filed summary appeal and successfully negotiated delay of license suspension with PennDOT. On summary appeal hearing date, negotiated plea where Reckless Driving charge reduced to a Traffic Control Devices violation, and speeding reduced to 25mph. 4 points imposed, but avoided 6.5 months of suspension and major CDL violation. 
  • Overtaking School Bus (Allegheny): Client represented self at magistrate level and convicted. Summary appeal filed to help in avoiding mandatory license suspension of 60 days and 5 points. esult: Negotiated delay of license suspension with PennDOT.
