DECEMBER 2017

Reckless Driving (Allegheny): Professional driver facing loss of employment due to 6 month license suspension upon conviction. Result: Negotiated reduction to Traffic Control devices violation, carrying no points or license suspension.

OCTOBER 2017

Fleeing and Eluding (F3) and Driving Under Influence of Drugs (Allegheny): Client with clean record facing permanent felony record, mandatory jail sentence of 72 hours, max of up to 7.5 years, and a mandatory 24-month license suspension upon conviction. Result: Negotiated entry into the ARD program for 2 years of probation and no jail time. License suspension reduced to 2 months. Upon successful completion, charges to be dismissed and expunged from record.
Prostitution (Allegheny): Client on temporary visa facing potential deportation and permanent criminal record. Result: negotiated reduction to summary disorderly conduct, a non-deportable offense, for fines/costs only.
30+ counts of Corruption of Minors (Indiana): Client accused of over 30 counts in connection with allegation of sexual conduct with a minor. Facing a max sentence of up to 5 years at each count, and a guideline range sentence of 3-6 months at each count. Result: Negotiated plea to 3 counts of Corruption of Minors, for no Megan's Law registration. Judge imposed 6-23 month period of county jail incarceration with permission for work release.
70 counts of Felony Possession With Intent to Deliver and Simple Possession (Washington): Client overcharged by police officer in connection with heroin possession facing significant jail time. Result: Negotiated tentative plea offer to one count of Possession of a Controlled Substance for 12 months probation. All felony charges to be dropped.
Terroristic Threats, Endangering Welfare of Child, Harassment (Lawrence): Client with clean record facing max of up to 11 years and 3 months of jail/probation and a permanent criminal record. Result: Negotiated tentative plea offer where EWOC charge dismissed and client to enter ARD program for 2 years of probation. Successful completion will lead to dismissal of charges.
DUI (Allegheny): Client incarcerated with multiple outstanding cases facing mandatory 72 hour jail sentence and max of up to 6 months. Result: Negotiated agreement to take 3 days credit for time serve, preserving jail credit towards other cases. Paroled after 3 days and 6 months probation.
Overtaking School Bus (Allegheny): Client represented self at summary trial and was convicted, facing 60-day mandatory license suspension and 5 points. Hired firm to file appeal. Result: Successfully argued for reduction of offense to a Traffic Control Devices violation, eliminating 5 points and 60 day suspension.
Exceeding Maximum Speed by 31mph (Allegheny): Client plead guilty to citation not realizing it carried 5 points and a 15 day suspension. Retained firm to file summary appeal. Result: Negotiated reduction to 5 mph over, carrying no points or license suspension.

Result: Further research into criminal record revealed conviction for a wet reckless driving offense in another state, making this a 1st offense DUI. Cleared out of state warrant on this case. Thereafter, negotiated admission into the ARD program, which will lead to record expungement upon program completion. No jail time and 12 months probation.
Speeding 31mph over (Butler): Junior Driver facing a cumulative 105 day license suspension and 5 points for an excessive speed conviction. Result: Negotiated reduction to 10mph over, reducing points from 5 to 2 and eliminating license suspension.
Reckless Driving (Allegheny): Client facing 6-month license suspension upon conviction. esult: Negotiated reduction to Careless Driving offense, a 3-point offense. Resolution eliminates license suspension.
DUI and Reckless Driving (Allegheny): Client facing 72-hour mandatory sentence, an 18-month license suspension and up to 6 months of probation. Result: Charges dismissed, laboratory results negative for alcohol or drugs.

Result: Negotiated reduction to summary disorderly conduct for fines/costs only. No probation violation for misdemeanors.
Underage Drinking (Washington): Repeat offender facing 90-day license suspension and criminal record. Result: Charge reduced to local ordinance violation for glass containers, a non-criminal violation eliminating license suspension.
Reckless Driving and Speeding 55mph over (Allegheny): CDL holder facing major CDL violation, mandatory license suspension of 6.5 months, and 5 points on driving record. esult: Client represented himself at magistrate's office and convicted of all charges. Our office filed summary appeal and successfully negotiated delay of license suspension with PennDOT. On summary appeal hearing date, negotiated plea where Reckless Driving charge reduced to a Traffic Control Devices violation, and speeding reduced to 25mph. 4 points imposed, but avoided 6.5 months of suspension and major CDL violation.

Middle Tier DUI (Washington): Client facing mandatory 12-month license suspension, mandatory 48 hour jail sentence and max of up to 6 months in jail. Result: negotiated offer for future entry into ARD program, reducing license suspension to 30 days, no jail time and ability to expunge record.
Corruption of Minors (M1), Possession of Controlled Substance and Possession of Drug Paraphernalia (Allegheny): Out of state client facing max sentence of up to 9 years in jail. Result: negotiated agreement for withdrawal of Corruption of Minors offense and guilty plea to remaining offenses for 2 years of non-reporting probation.
